Agreement to terms

By accessing or using Naru ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not access or use the Service.

You must be at least 13 years of age to use the Service, in accordance with Discord's Terms of Service. If you're using the Service on behalf of an organization, you represent that you have the authority to bind that organization.

Description of service

Naru is a Discord bot providing AI-powered conversation and various features to enhance your Discord server experience. Features include, but are not limited to:

• Natural language conversation and chat interactions.
• Anime and media recommendations.
• Reminder and scheduling functionality.
• AI-powered image generation.
• Web search capabilities.

The Service is provided "as is" and we make no guarantees regarding uptime, availability, or uninterrupted access.

User conduct

When using the Service, you agree not to:

• Use the Service for any illegal activities or to violate applicable laws.
• Harass, abuse, threaten, or intimidate other users.
• Send spam, unsolicited messages, or abuse the Service in any way.
• Attempt to exploit, hack, or compromise the security of the Service.
• Use automated tools, scripts, or bots to interact with the Service beyond normal usage.
• Scrape, data-mine, or collect information from the Service without authorization.
• Interfere with or disrupt the Service or servers connected to it.

We reserve the right to terminate or suspend your access to the Service at any time, without prior notice, for violations of these Terms.

Premium subscriptions

Certain features are available through paid premium subscriptions.

• Subscription prices may change with reasonable notice.
• Payments are processed through third-party payment processors; you agree to their respective terms.
• Subscriptions automatically renew unless cancelled before the renewal date.

Intellectual property

The Naru name, logo, and all associated branding, graphics, and content are our exclusive property and are protected by intellectual property laws. You may not use, copy, or distribute any of our intellectual property without prior written consent.

Content you create or submit through the Service remains your property. By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to process, store, and transmit your content solely to provide and improve the Service.

AI-generated content

Naru uses AI to generate text and images. Please note:

• AI responses may not always be accurate, complete, or appropriate.
• We do not guarantee the accuracy, reliability, or suitability of AI-generated content.
• AI-generated images are subject to usage restrictions and may not be used for illegal purposes.
• You are responsible for verifying any information provided by the AI before relying on it.
• Do not use AI-generated content to deceive others or for malicious purposes.

Limitation of liability

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or intangible losses resulting from:

• Your access to or use of, or inability to access or use, the Service.
• Any conduct or content of any third party on the Service.
• Any content obtained from the Service.
• Unauthorized access, use, or alteration of your transmissions or content.

Our total liability for all claims related to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Naru and its operators from any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your access to or use of the Service.
• Your violation of these Terms.
• Your violation of any third-party rights, including intellectual property rights.
• Any content you submit, post, or transmit through the Service.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason — including breach of these Terms.

You may stop using the Service at any time. Upon termination, your right to use the Service will immediately cease.

Provisions of these Terms which by their nature should survive termination — including ownership, warranty disclaimers, indemnity, and limitations of liability — will survive.

Changes to terms

We may modify or replace these Terms at any time. If a revision is material, we'll give at least 30 days' notice before new terms take effect. What constitutes a material change is at our sole discretion.

By continuing to use the Service after revisions take effect, you agree to be bound by the revised terms. If you don't agree, please stop using the Service.

Governing law

These Terms shall be governed and construed in accordance with applicable laws, without regard to conflict of law provisions.

Disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with applicable rules.
